Terms of Use

NexArt PLAYER is a player application. You pay for the app — never for content. Channels, movies and series come from the playlist you add, contracted with a provider that is not us.

1. Who we are

These Terms govern the NexArt PLAYER application, hereinafter "NexArt". By installing, activating or using the app you agree to these Terms. If you do not agree, do not use the app.

2. What the app does — and what it does not

NexArt PLAYER plays the channel, movie and series playlists you add. It organises, displays and plays whatever your playlist delivers.

• We do not host, transmit, index or sell content.
• We do not supply playlists, channels, credentials or content servers.
• We have no relationship with your playlist provider, and no control over what it offers, its signal quality or how long it stays online.

You pay for the app. Access to content is a separate relationship between you and your provider.

3. How activation works

The app is tied to the device, identified by its MAC address and a 6-digit Key, both shown inside the app itself. There are two paths:

Directly with us. You activate on our website by entering the device’s MAC and Key and completing the payment.

Through a partner. An authorised reseller activates the device for you, usually together with their playlist code or DNS. In that case billing and commercial support belong to the partner; we answer for the app itself.

Each activation covers one device. Switching TVs requires a new binding — contact us and we will transfer the activation, provided the previous device stops using it.

4. Payment

For direct purchases we accept the methods shown on the checkout screen — such as Pix and card, handled by payment providers. The price and validity period of the activation are the ones shown before confirmation.

Payment is processed by the chosen provider. We do not receive or store your card details — they are handled directly by the processor under its own policy. We keep only the record that the activation was paid.

Purchases made through app stores follow the store’s own rules, including billing and refunds.

5. Cooling-off and refunds

Online purchases carry a cooling-off right of 7 calendar days from payment confirmation, under art. 49 of the Brazilian Consumer Code. Just write to our contact address with the device’s MAC and Key; we refund through the same payment method and the activation is switched off.

After that period there is no refund for a change of mind. Your statutory rights remain, of course, whenever the app has a defect we cannot fix.

A problem with your playlist — a channel down, a catalogue different from what was promised, poor signal, a vanished provider — does not entitle you to a refund of the app, because the playlist is not our product. Contact whoever sold it to you.

6. Licence

You receive a personal, non-transferable, non-exclusive licence to use the app on the activated device for private purposes. The app, its name, logo and screen designs remain ours.

Reselling, renting, sublicensing or distributing the app without written permission is not allowed, nor is commercial public display without the proper licence from the content rights holders.

7. The playlists are yours — and so is the responsibility

By adding a playlist you declare you have the right to use it. We do not verify, filter, or have any way of knowing what exists inside a third-party server.

If a rights holder identifies infringing content, the request must be directed to the provider hosting it — we have no technical access to remove what is not with us. We cooperate with authorities when formally required.

8. Prohibited use

• Using the app to distribute content without the rights holders’ permission.
• Sharing, cloning or reselling your activation.
• Attempting to bypass the device binding, or decompiling or modifying the app.
• Overloading, probing or attempting to break into our servers.
• Using the app for public or commercial display without the proper licence.

9. Availability and updates

We work to keep the service up, but we do not promise uninterrupted operation: there may be maintenance, network failures, policy changes by TV manufacturers or downtime at your provider.

The app may be updated to fix defects, improve performance or meet store and manufacturer requirements. Features may change over time.

10. Suspension and termination

We may suspend or terminate an activation, without refund, upon violation of these Terms — especially sharing or reselling the activation, payment fraud or improper chargebacks.

You may stop using the app at any time by uninstalling it. To delete the device record and the playlists tied to it, see the Privacy Policy.

11. Limits of our liability

We answer for the functioning of the app. We do not answer for the content of third-party playlists, the conduct of providers or resellers, the quality of your internet connection, or downtime caused by services that are not ours.

Nothing here removes rights that Brazilian law guarantees to consumers.

12. Changes, governing law and venue

These Terms may change; the date at the top marks the latest version, and relevant changes are announced in the app. Continuing to use the app after a change means accepting it.

Brazilian law applies. The courts of São Paulo/SP are elected as venue, preserving the consumer’s right to sue in their home jurisdiction.
